These Terms of Service ("Terms") govern your use of the Doctors of Cannabis website, telemedicine platform, and all related services provided by Doctors of Cannabis, LLC. ("we," "us," or "DOC"). By using our services, you agree to these Terms. If you do not agree, please do not use our platform.

Federal Notice: Marijuana remains illegal under U.S. federal law, regardless of state-level legalization. Doctors of Cannabis does not provide, facilitate, or encourage any activity that violates federal law. Our services are limited to connecting patients with licensed physicians for state-authorized medical evaluations and assisting with state application processes where permitted.

1. Who Can Use Our Services

You must be 18 years of age or older to use any Doctors of Cannabis services. By creating an account or booking an evaluation, you confirm that you are at least 18. We do not knowingly collect information from or provide services to anyone under 18. If we determine that a user is under 18, we will immediately terminate their account and delete any associated data.

2. What We Provide

Doctors of Cannabis is a physician-led telemedicine platform that connects patients with board-certified, state-licensed doctors for medical marijuana evaluations. Depending on your state and the service you select, we may also assist with your state medical marijuana card application. Here is exactly what our services include and do not include:

  • Connect you with a licensed physician for a telemedicine evaluation
  • Assist with state medical marijuana card application processes where permitted
  • Guide you through state portal requirements, including login setup and form submission in applicable states
  • Provide reminders and follow-up support during your application process
  • Process your payment securely for the services you select
What We Do Not Do
  • Guarantee that you will qualify for a medical marijuana recommendation – that decision is made solely by the physician
  • Provide, sell, or facilitate the purchase of marijuana or marijuana products
  • Act as your attorney or provide legal advice
  • Replace your primary care physician or serve as an ongoing healthcare provider
  • Bill or interact with your health insurance in any way
3. The Evaluation and Physician Independence

When you book an evaluation with Doctors of Cannabis, you will be connected with an independent, licensed physician. The physician conducts your evaluation and makes their own professional determination about whether to issue a medical marijuana recommendation. We do not instruct, influence, or pressure any physician to approve or deny a recommendation.

The physician's decision is final. If the physician determines that medical cannabis is not appropriate for you, you will not receive a recommendation. This is a medical judgment, and we respect the independence of every doctor in our network.

4. Payment and Refund Policy

Our services are cash-pay only. We do not accept insurance for any of our evaluations or application services because medical cannabis cannot be billed through health insurance under current federal law.

Evaluation Fee

You will be charged the evaluation fee for your state at the time of booking. If the physician does not approve your recommendation, you will receive a full refund of the evaluation fee. No questions asked.

Application Assistance Fee

If you select our application assistance service, you will be charged an additional fee for our team's help with your state portal submission. This fee covers the work we do on your behalf to submit and monitor your application.

Our Approval Guarantee

When you purchase our full-service package (evaluation plus application assistance), we guarantee that we will do everything in our power to get your application approved by the state. If your state application is denied due to an error on our end, we will correct it and resubmit at no additional charge. If you are ultimately not approved despite our efforts, you are eligible for a refund of the application assistance fee.

Refunds are processed within 10 business days of your request. To request a refund, email legal@docsofcannabis.com with your account details and the reason for your request. Refunds related to state denial will require documentation from the state.
5. Your Account

To use our services, you will create an account on our platform. You are responsible for keeping your account information accurate and your login credentials secure. You must not share your account with anyone else.

You agree to provide truthful and accurate information during registration and throughout your evaluation. Providing false information to a physician during a medical evaluation is a serious matter and may have legal consequences. We reserve the right to terminate your account if we believe any information you provided is false or misleading.

6. Your Responsibilities

When you use Doctors of Cannabis, you agree to the following:

  1. Be truthful with your physician about your medical history, current medications, and conditions.
  2. Be at least 18 years old.
  3. Be a resident of the state in which you are seeking a medical marijuana card.
  4. Comply with all applicable federal, state, and local laws.
  5. Not use our platform to obtain a recommendation for any purpose other than a legitimate state medical marijuana program.
  6. Not attempt to access another user's account or information.
  7. Not use our platform in any way that could harm other users or the integrity of our services.
7. Intellectual Property

All content on the Doctors of Cannabis website - including text, images, logos, graphics, and other materials - is owned by Doctors of Cannabis, LLC. or its licensors and is protected by copyright and other intellectual property laws. You may not copy, reproduce, distribute, or use any of our content without our written permission.

8. Links to Third-Party Websites

Our website may link to third-party websites or services that are not owned or controlled by us. We are not responsible for the content, privacy practices, or terms of any third-party site. If you visit a linked site, you do so at your own risk.

9. Limitation of Liability

To the fullest extent permitted by law, Doctors of Cannabis, LLC. is not liable for any indirect, incidental, special, or consequential damages arising from your use of our services. This includes, but is not limited to, damages for loss of profits, data, or goodwill.

Our total liability to you for any claim arising from these Terms or your use of our services is limited to the amount you actually paid to Doctors of Cannabis for the specific service at issue.

10. Disclaimer of Warranties

Our services are provided "as is" and "as available" without any warranties of any kind, either express or implied. We do not guarantee that our services will be uninterrupted, error-free, or free of viruses or other harmful components.

We do not guarantee any specific outcome from a physician evaluation or state application process. The physician's recommendation and the state's approval are beyond our control.

11. Indemnification

You agree to defend, indemnify, and hold harmless Doctors of Cannabis, LLC., its officers, directors, employees, and agents from any claims, damages, or expenses (including attorney's fees) arising from your use of our services, your violation of these Terms, or your violation of any third party's rights.

12. Changes to These Terms

We reserve the right to update these Terms at any time. If we make changes, we will post the updated Terms on our website with a new effective date. By continuing to use our services after changes are posted, you agree to the updated Terms.

13. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Oklahoma, without regard to its conflict of law principles. Any disputes arising from these Terms will be subject to the exclusive jurisdiction of the courts located in Oklahoma City, Oklahoma.
